Republican County Commissioner Harry Foy responded to our email about Democratic Commission Chairman Sidney Dunston's March 16 countywide curfew proclamation, which he put into effect beginning this past Sunday from 9 p.m. until 6 a.m. daily.
Dunston's curfew notice was in an email that was sent last Friday, April 3.
In Dunston's proclamation, he said he was able to implement the curfew pursuant to NC General Statutes.
But Foy wrote, "I was not aware of any curfew whatsoever. And I have been to all legal meetings."
In fact, there was no curfew item on the March 16 commissioners' agenda.
Also, in a follow-up email sent to the Franklin GOP by Youngsville Mayor Fonzie Flowers wrote, "Not only do I find curfew restrictions unconstitutional, but the manner in which it evolved was poorly planned and there was no buy-in from any of the municipalities, not even a heads up until the email was released."
He added, "I do want to point out that I, as well as my commissioners and Town Hall/Police Department staff, take this virus very seriously.
"A curfew would put my officers in harm's way by making them perform unconstitutional traffic stops and the subsequent engagement of citizens for no clear reason at all.
"I prefer my officers being ready and attentive to respond to emergencies, not pulling over vehicles for no valid reason.
"In addition, I feel that this also applies to the county as a whole, but that is up for the county to decide."
Earlier today, Louisburg is also enforcing Dunston's daily 9 p.m. until 6 a.m. curfew.
Dunston was contacted by us by an email at 6:18 p.m., Sunday, April 5, and he has yet to respond to clarify that his curfew proclamation was conducted at the March 16 meeting.
