Dismissed! All Charges Dropped Against Commissioner Harry Foy

 

The following is a statement from attorney Larry Norman:

All criminal charges pending against Franklin County Commissioner Harry Foy stemming from an alleged incident which occurred on Foy's boat on the Pamilico Sound on August 15, 2007 in Dare County were dismissed this morning by an Assistant Dare County District Attorney. Foy was charged with assault on a female, possession of marijuana and possession of drug paraphernalia in the Dare County cases. The prosecuting witness in the assault on a female charge, Laurie Boemper, entered a plea of guilty and was found guilty on a charge of possession of drug paraphernalia arising out of the same incident.
 
Foy's attorney, Larry Norman, said the district attorney dismissed the cases in open court shortly after noon today (February 14).  "We were in Court with a number of witnesses and ready for trial when the assistant district attorney dismissed the cases. "We are delighted that the charges against Harry have been dismissed.  The evidence in the case indicated that Harry Foy was not guilty on all charges and the prosecuting witness had recanted in later statements that she made.  There was no evidence of any personal injuries to Ms. Boemper and the two eyewitnesses stated that it was Ms. Boemper, who in an intoxicated state, attacked Harry Foy. We were confident that in trial Harry Foy would have been completed exonerated.  The Assistant District Attorney apparently agreed with that assessment and dismissed the cases".
 
Norman went on to say that the news accounts of this matter were inaccurate and that "it is a shame that Harry Foy has been subjected to damaging statements and news accounts and editorials about his character. Anybody who knows Harry knows that he was innocent. I am glad that the judicial system has reached the same conclusion".
 
Charges against Robert Taylor and Chris Zimmerman, two passengers on the boat, were also dismissed.
